Terms and Conditions

These terms are the agreement between you and Katlego Nexus (Pty) Ltd when you use Plate2Peer: the website, the WhatsApp service or anything else we offer under the Plate2Peer name. They are written to be read. If anything is unclear, ask us before you buy or sell.

By creating an account, placing an order or chatting with Plate2Peer on WhatsApp, you agree to these terms. If you do not agree, please do not use Plate2Peer.

1.Who we are

Plate2Peer is a brand and trading name of Katlego Nexus (Pty) Ltd, which owns and operates it. Plate2Peer is not a separate company. In these terms “Plate2Peer”, “we”, “us” and “our” mean Katlego Nexus (Pty) Ltd trading as Plate2Peer. “You” means the person using Plate2Peer, as a buyer, a seller or both. Our company details are at the end of this page.

2.The documents that make up this agreement

These documents form part of these terms. Please read the ones that apply to you:

If these terms and one of those documents say different things, the more specific document applies to its subject.

3.What Plate2Peer is, and our role

Plate2Peer is an online marketplace. We connect buyers with independent sellers, such as students and small businesses. We do not make, own, store or deliver the products listed, and we do not check every product. When you buy, your contract of sale is with the seller, not with us.

We collect payment for orders as the seller's agent. When you pay Plate2Peer for an order, you have paid the seller. We hold the money until the order is handed over and the protection window has passed, then pay the seller their share.

Sellers are responsible for their products, including their quality, safety, labelling, description and legality, and for delivery or collection. We are responsible for running the platform with reasonable care and skill, for holding and paying out money correctly, and for handling problems fairly as these terms describe.

4.Who can use Plate2Peer

  • You must be 18 or older to sell, tell us who you are (students with their university email and student number, others with their ID number), and confirm it again every 3 months.
  • If you are under 18, you may only buy with the permission of a parent or guardian, who is responsible for your use of Plate2Peer.
  • You need a South African cellphone number to place orders and to use the WhatsApp service.
  • You may not use Plate2Peer if we have closed your account or blocked your number, or if the law does not allow you to.

5.Accounts

  • Keep your login details private. You are responsible for what happens on your account and on your phone.
  • Give us accurate details, especially your cellphone number, which is used to complete orders, and keep them up to date.
  • One person, one account. Do not create an account for someone else or pretend to be someone else.
  • Tell us straight away if you think someone else has used your account or your order links.

6.Buying, prices and delivery

  • Prices are in South African rand and include everything Plate2Peer charges. Orders under R30 have a R2 small-order fee, which goes to Plate2Peer and is shown before you pay.
  • Placing an order is an offer to buy. It becomes a binding sale when your payment is confirmed. While you pay, the items are held for you for a few minutes; an order that is not paid in time is cancelled and nothing is charged.
  • If an item sold out just before your payment came through, the order is cancelled and you get a full refund. If a price was clearly wrong, the seller or we may cancel the order, with a full refund.
  • You choose collection or delivery from the options the seller offers. Delivery costs, if any, are agreed directly between you and the seller and paid to the seller; they do not go through Plate2Peer.
  • Ownership and risk pass to you when the order is handed over to you (or to the person you asked to collect it).
  • Your order page shows the full record of your order, and you can keep a copy of it. Anyone with your private order link can see the order, so only share it with people you trust.

7.Payment

Payments are made on the secure page of our payment provider, Yoco, by card or Instant EFT. We never see or store your card details or banking login. Only pay through the links Plate2Peer gives you, and never pay a seller directly for an order placed on Plate2Peer: money paid outside Plate2Peer is not protected.

8.Cancelling and refunds

In short (the Refund and Cancellation Policy has the detail):

  • Before you pay, you can cancel an order yourself.
  • After you pay, you can ask the seller to cancel until the order is handed over. If they agree, or if they cannot fulfil it, you get a full refund.
  • After it is handed over, you have 48 hours to report a problem, and we decide what is fair.
  • Refunds go back to the account you paid with.

9.Buyer protection and the 48 hours window

When you pay, we hold the money. Once the seller marks your order as delivered or collected, you have 48 hours to tap “I received it” or report a problem. If you do neither, the order completes automatically and the seller is paid.

If you report a problem, the seller's payout is frozen until the problem is decided.

10.Problems with an order

  • Tell us what went wrong, add a description and up to three photos.
  • The seller has 24 hours to respond with their side.
  • We decide within 72 hours of your report: pay the seller, refund you in full, or refund you in part.
  • A seller who loses a dispute gets a strike. After 3 strikes the store is suspended, and we review it before it can reopen.
  • If a seller has not fulfilled a paid order within 5 days, you can report it as not delivered.
  • Our decision settles what happens to the money we hold. It does not take away any right you have to take the matter further (see “Complaints” below).

11.Seller fees

  • Registration: R29 once off, which includes your first month.
  • Keeping your store live: R120 a year or R15 a month, paid upfront. If a payment is more than 7 days late, your store is hidden until it is paid.
  • Commission: 8% of the product total on each sale, deducted from your payout.
  • Payment processing: the payment provider's fee is shared between you and Plate2Peer in proportion to each share of the payment.
  • Premium (optional): R49 a month. The first 50 premium sellers pay R29 a month for as long as their premium stays active.

The Seller Agreement sets out the rest of what sellers agree to, including payouts, fee changes and when fees are refunded.

12.Using each other's contact details

After payment, the buyer and seller receive each other's name and number so they can complete the order. Use them only for that order. Marketing, spam or harassment using these details is not allowed and can lead to your account being closed.

13.Messages and WhatsApp

You can message sellers, buyers and our team in Plate2Peer, and use Plate2Peer on WhatsApp under the WhatsApp Terms of Use. Keep messages about the order, and be respectful.

Our team can read messages about an order when they need to, for example to resolve a problem or to keep the platform safe. Never send passwords, card details or ID numbers in a message: we will never ask for them.

14.Feedback and reviews

  • After you get an order, we may ask you to rate the store, the products and Plate2Peer, on the order page or on WhatsApp. It is optional, and possible for 14 days.
  • Only buyers who received an order can review it, once. Reviews must be honest and about that order: no abuse, personal details, links or advertising, and no reviews in return for a reward or under pressure.
  • Stores choose whether reviews show on their pages. If they do, every review shows and counts; stores cannot change, remove or pick them. We may hide a comment that breaks these rules (its stars still count), and we keep all feedback.

15.What you may not do

  • Break the law, or buy or sell anything on the prohibited items list.
  • Place fake orders, make false reports or disputes, or try to get a refund you are not entitled to.
  • Ask for or make payments outside Plate2Peer for orders placed on Plate2Peer, or otherwise avoid our fees.
  • Harass, threaten or discriminate against anyone, or post offensive, misleading or unlawful content.
  • Pretend to be someone else, including Plate2Peer or our team.
  • Interfere with the platform: probe for weaknesses, copy data with automated tools, overload our systems, or get into accounts or information that are not yours. These can be crimes under the Cybercrimes Act.

16.Content and our name

The Plate2Peer name, logo, design and software belong to Katlego Nexus (Pty) Ltd. You may not copy or use them without our written permission, except to share links to Plate2Peer.

You keep ownership of what you post (listings, photos, messages and reviews). You allow us to show, copy and adapt it for running and promoting Plate2Peer, for as long as it is on Plate2Peer, without payment. You confirm you have the right to post it.

17.Limits on our responsibility

As far as the law allows:

  • We are not responsible for loss or harm caused by a seller's products, a seller's or buyer's actions, or information someone else posted. Your claims about a product are against the seller, and we will help you through the process in the Refund and Cancellation Policy.
  • Plate2Peer is provided as it is. We do not promise that it will always be available, error free or free of interruptions, for example during load shedding or when a service we rely on is down.
  • We are not responsible for indirect or consequential loss, such as lost profit, lost opportunity or lost data.
  • If we are responsible for a loss, our total responsibility is limited to the amount you paid for the order concerned or, for sellers, the fees you paid us in the three months before the claim.

None of this limits our responsibility for loss caused by our gross negligence, fraud or wilful misconduct, or any right you have under the Consumer Protection Act, the Electronic Communications and Transactions Act or other law that cannot be excluded.

18.Covering our costs if you break these terms

If you break these terms or the law while using Plate2Peer, and someone claims against us because of it, you agree to cover the reasonable costs, losses and damages we suffer as a result, including reasonable legal fees. This does not apply to the extent that the loss was caused by our own negligence or breach.

19.Suspending or closing accounts

We may hide listings, hold an order or payout while we look into something, block a number, suspend a store or close an account that breaks these terms, puts others at risk, or is used for fraud. Where it is safe to, we tell you why and give you a chance to respond.

You can close your account at any time from your account page. We keep records of past orders for as long as the law requires, as the Privacy Policy explains.

20.Things beyond our control

We are not responsible for delays or failures caused by events we cannot reasonably control, such as load shedding, network or banking outages, problems at WhatsApp, Yoco or our other providers, protests, natural disasters or changes in the law. We will do what we reasonably can to limit the effect on you.

21.Communicating electronically

You agree that we may communicate with you electronically: by email, WhatsApp, SMS or on Plate2Peer. Messages, order confirmations and the records on your order page count as being in writing. An electronic message is received when it reaches the address or number you gave us.

22.Complaints

Tell us first, through Messages on Plate2Peer or at the contact details below, and we will try to sort it out within 10 working days. If you are not happy with our answer, you may take a consumer complaint to the Consumer Goods and Services Ombud (cgso.org.za) or the National Consumer Commission (thencc.org.za), and a privacy complaint to the Information Regulator (inforegulator.org.za). You can also go to a court with jurisdiction.

23.Changes to these terms

We may change these terms, for example when we add features or the law changes. We will tell you before important changes take effect, by email, WhatsApp or a notice on Plate2Peer, and show the new version number at the top of this page. If you keep using Plate2Peer after a change takes effect, the new terms apply. Sellers get the notice described in the Seller Agreement. Orders placed before a change stay under the terms that applied when they were placed.

24.General

  • These terms are governed by the law of the Republic of South Africa.
  • If a court finds part of these terms invalid, the rest still applies.
  • If we do not enforce a right straight away, we have not given it up.
  • We may transfer this agreement to another company in our group, or to a company that takes over Plate2Peer, if your rights are not reduced. You may not transfer it without our written agreement.
  • Our address for legal notices is the physical address below. Yours is the email address or cellphone number you gave us, unless you tell us otherwise in writing.
  • These terms and the documents they include are the whole agreement between us about using Plate2Peer.
